Privacy Policy

Ticatag allows you to have peace of mind while simplifying your life. This policy identifies the information we collect and how we use it as part of our mission.
Respecting your privacy is essential to us, and therefore, we ensure to collect only the information we need to provide you with the best possible experience.
As you review our policy, keep in mind that it applies to the website, mobile app, and support center of TICATAG SAS (hereinafter, "Ticatag" or "We"), as well as the various related services we provide (the "Services").

1. INFORMATION COLLECTED BY TICATAG

In this Privacy Policy, the term "Personal Information" refers to any information relating to an identified or identifiable natural person. An identifiable person is someone who can be identified, directly or indirectly, by their name, identification number, or, in some cases, by geographic data, an IP address, or the unique identifier assigned to each Ticatag device. We collect the following information from you, which may include Personal Information.
If you do not provide the necessary Personal Information when requested, you will not be able to fully use our Services.

A. Placing an order

i. Contact details

When placing an order on our website, or when responding to a specific request, you must provide your email address, first and last name, and a shipping address. In some cases, we may also require your phone number.
ii. Payment information
To complete an order on our website, you must provide a payment method and supply information such as your credit card number or PayPal account details. This information allows us to process your order and is not stored on our servers.

B. Mobile app registration

You must use a valid email address and create a password to obtain an account and access the Services on the Ticatag app. You may use your first and last name if you wish.
We do not personally identify you to other users, nor do we make your account information available to third parties in any way that could identify you without your prior consent.

C. Social Network Login

When you create a Ticatag account, you have the option to log in and interact with a third-party social networking service ("Social Network"). If you choose to interact with a Social Network while using our Services, you authorize us to collect the Personal Information already published on your account on that Social Network. You can manage this information in the privacy settings of each Social Network.

D. Information about your use of the Services

i. Ticatag ID, name, and photo
When you activate a Ticatag using the Ticatag app, the unique identifier of the Ticatag (or Ticatag ID) is then associated with your account. If you choose to assign a name to your Ticatag or add a photo of it, this information will also be associated with your account.
ii. Geographic Data
Ticatag is designed to find lost items. To do this, we need to collect geographic data about you. The term "Geographic Data" refers to the combined geographic data from your phone or device and your Ticatag devices.
When the app is open on your device, it regularly transmits your Geographic Data. This allows us to show the last known location of your Ticatag on the map ("Last Known Location"). This is primarily how Ticatag helps you find your lost items.
Ticatag normally only displays the most recent Geographic Data of each of your Ticatag devices in your app to indicate the Last Known Location. For Ticatag Premium users, the Geographic Data of each Ticatag device is displayed in your app for 30 days to support the Location History feature. In both cases, Ticatag records this data to provide you with the most recent Geographic Data for your Ticatag devices if you lose them.
The archiving methods for Geographic Data, archived separately from your account data, prevent linking to your account data through a pseudonymization process. Ticatag retains this archived data so that we can answer general questions unrelated to anyone, such as: "How many Ticatag devices were in Paris in 2019 compared to 2018?"
We may also collect and update the Location Data of your Ticatag devices anonymously from other Ticatag users running the Ticatag app or from third parties using an app or device that integrates the Ticatag feature (each being a "Ticatag Locator") within Bluetooth range of your device. This allows us to indicate the most accurate and recent location of your Ticatags, even when they are out of Bluetooth range of your device. These updates are essential to the Ticatag Community as they enable Ticatag Locators to help each other find their Ticatag devices. Similarly, your app can anonymously assist other community members in locating their Ticatag devices! The Location Data provided is anonymous and does not allow the identification of the owner of a Ticatag device to others, or vice versa.
If you use a computer, phone, or other device to access our website or support center, we use its IP address to determine its approximate geolocation. This allows us to improve your experience by offering you a more personalized service.
In addition to using it to provide you with the Services, we may use your Location Data to promote the Services or to present you with offers. However, we never share your Location Data with other users unless you choose to share it through our Services.
iii. Usage information related to the mobile and Windows applications
We track the mode and frequency of use of our Services, including on our mobile and Windows applications. For users of our mobile app, we also collect certain information transmitted by your mobile device when you use it as part of our Services, including details about the model, type, and operating system version of your device, as well as the dates and times of your requests. We use this information to provide you with optimal services and support, and to gather statistics to better understand our user base.

E. Information collected through Ticatag support services

Our support service is accessible on our website, via live chat, or by sending direct emails and email requests. We collect the Personal Information you choose to provide to our customer service through these channels. This information includes your name, email address, phone number, and postal address. We may use and process your Personal Information, including your Geographic Data, to manage your support requests and provide you with the best possible assistance. You may also choose to submit a diagnostic report to the Ticatag support team for troubleshooting purposes.

F. Human Resources Data

Ticatag collects Personal Information from its current, past, and prospective employees, including emergency contact details and insurance policy beneficiaries ("Human Resources Data"). The Human Resources Data we collect may include title, name, address, phone number, email address, date of birth, passport number, driver’s license number, social security number or other government-issued identification number, check financial data, and bank details used for salary transfers. It also includes information contained in resumes or application files, language skills, emergency contact details, and insurance policy beneficiaries.
To achieve our diversity goals, we may also collect sensitive Human Resources Data such as medical or disability history, including psychological health, sick leave, or maternity leave, as well as information on national origin or immigration status and other optional demographic data such as race.
We collect, store, use, and process Human Resources Data for various professional purposes, including:
workflow management, including project assignment, management, and administration; human resources and related communication administration; payroll preparation and provision of employee benefits; compensation, including bonuses and management of long-term incentive programs, employee stock ownership plans management, compensation analysis, including overtime monitoring and compliance with labor laws and corporate recognition programs; job classification activities; employee performance and development management; organizational development and succession planning; benefits and personnel management; absence management; help desk and IT support services; regulatory compliance; government or internal and/or external compliance investigations; internal or external audits; litigation assessment, lawsuit management, and defense; diversity and inclusion initiatives; restructuring and relocations; emergency services and contacts; employee safety; regulatory requirements compliance; employee travel and business expense processing; and finally, acquisitions, divestitures, and integrations.

G. Information from other sources

To complement the information you provide to us, we also receive data from other sources, including third-party services and organizations. For example, if you access our Services through a third-party application, an App Store, or a Social Network, we may collect from that third-party application the data about you that you have made public in your privacy settings. The information we collect through App Stores or Social Network accounts includes your name, social network user ID, social network username, location, gender, date of birth, email, profile picture, and your contacts on the relevant Social Network. This additional information allows us to verify the data you provide to Ticatag and better inform you about our activities, products, and Services.

2. COOKIES AND OTHER WEB TECHNOLOGIES

A. Cookies

When your browser is set to accept them, cookies, which are small text files, are placed on your computer's hard drive or in your mobile device's memory. Like many other online services, cookies and similar tools help us collect information about how you use our Services to better understand it. Although most web browsers automatically accept cookies, you can change your settings or use third-party tools to ask you whether you want to accept or reject cookies from websites you choose to visit before doing so automatically for you. You can even delete them via your browser. Most browsers also offer settings that allow you to refuse new cookies, be notified when a new cookie is received, or delete or disable all cookies. However, some parts of our Services may not function if you disable cookies.

B. Use of Cookies

Thanks to cookies, we can simplify your use of the Services. For example, cookies allow us to remember you when you return to our website, identify you when you log in, authenticate your access, track preferences or choices you set in the app, tailor content to your profile or geographic area, display a personalized browsing history, and/or provide you with specific technical support.
We may also use them to evaluate your use of our site, conduct research and diagnostics to improve the content, products, and services we offer you, and analyze overall web traffic.
The cookies we use expire once their purpose is fulfilled. Some cookies expire when you close your browser (session cookies) or after a set period (persistent cookies). For cookies placed by third parties (explanations are provided below), the expiration period is set by those third parties, not by us.

C. Web Beacons

Web beacons (also known as invisible pixels or spies) are small image files with a unique identifier that can be included in our Services for various purposes, including providing or communicating with cookies, tracking and measuring the performance of our Services, monitoring the number of visitors who have viewed our Services, and assessing the effectiveness of our advertising. Unlike cookies, which are stored on the user's hard drive, web beacons are usually embedded invisibly on web pages (or in an email).

D. Do Not Track

Although our website and the Ticatag app do not currently recognize automated browser signals regarding tracking mechanisms, such as “Do Not Track” instructions, you can generally set your privacy preferences for the use of most cookies and similar technologies in your web browser as described above.

3. COLLECTION OF YOUR PERSONAL INFORMATION BY THIRD-PARTY SERVICES

Ticatag sometimes uses third-party service providers. These third-party service providers may place cookies on your computer’s hard drive or in your device’s memory, or use web beacons to collect or receive information from the Services or elsewhere on the Internet, and use this information to perform analytics and target advertising. The information processing practices of external services are not covered by this Privacy Policy. We cannot access or control the cookies or other web technologies they may use.

A. Web Analytics Services

We use third-party web analytics services that use cookies or other web technologies to collect usage information associated with an IP address to help us analyze how our users use our website and certain parts of the Ticatag app.
We collect such information to improve the overall experience of our Services for our users.
We use Google Analytics, a service provided by Google, Inc., to gather information about how users and visitors use our Site and Services. For more information about Google Analytics, visit https://www.google.com/policies/privacy/partners. You can opt out of Google Analytics at https://chrome.google.com/webstore/detail/google-analytics-opt-out/fllaojicojecljbmefodhfapmkghcbnh?hl=en.
These external services may also collect information about your use of other websites over time. Since we do not associate any personal information you provide to us in the app with the information we store in third-party analytics software, the analysis of this information cannot in any way identify you.

B. Social Media Plug-ins and Widgets

We may use plugins, widgets, or other Social Network features (each being a "Social Network Feature") made available by and/or that access third-party Social Networks. These Social Network Features allow the Social Networks to place cookies on your browser and collect certain information that may be associated with your name and your personal account on the Social Network.
These Social Network Features are managed solely by the respective Social Networks and their service providers, and we recommend that you carefully read their privacy policies before using them. We cannot control or access the information collected, stored, or used by the Social Networks, and the practices related to Social Network information are not covered by this Privacy Policy.
If you do not wish to associate the information collected via plugins, widgets, and/or other features with the information in your personal account on the Social Network, you should refrain from using the Social Network Features and log out of your account before accessing our Services.

C. Payment Processing by Third Parties

When you purchase a Ticatag device, we process your payments through a third-party application, including the Apple App Store, Google Play App Store, Amazon App Store (collectively referred to along with all similar apps as the "App Stores"), and Social Networks such as Facebook. The third-party application may collect financial data about you to process a payment on behalf of Ticatag, including your name, email address, address, and other billing information.

4. WE ARE NOT RESPONSIBLE FOR THE CONTENT OF THIRD-PARTY WEBSITES

Our Services may contain links to websites and services that are managed and operated by third parties (each being a "Third-Party Service"). All information you provide on or to a Third-Party Service, or collected by a Third-Party Service, is provided directly to the owner or operator of that Third-Party Service and is subject to their privacy policy. We are not responsible for the content, privacy, and security practices and policies of Third-Party Services. To protect your information, we recommend that you carefully read the privacy policies of all Third-Party Services you access.

5. WE MAY NEED TO USE AND DISCLOSE YOUR PERSONAL INFORMATION FOR THE PROVISION, IMPROVEMENT, AND PROMOTION OF OUR SERVICES.

A. Use of Your Personal Information

We may use your Personal Information and Geographic Data to provide you with better service, improve the quality of our products and Services, and promote our Services. You can contact us at any time to object to the use of your Personal Information for promotional purposes, in accordance with the terms of Article 9 below.
iv. Research and Development
Ticatag may use Personal Information to create non-identifiable information that we can use alone or in combination with other data from other sources, in order to optimize the delivery of our current products and Services or to develop new ones. Ticatag may occasionally conduct surveys (online and offline) as part of studies. To do this, we may use independent service providers. Participation in these surveys is not mandatory, and we will use the information collected to conduct market research or prepare reports to better serve our users by understanding their needs and obtaining feedback on the quality of the products and services we provide. Survey responses will help evaluate the effectiveness of our Services, the various types of communication we use, our advertising campaigns, and/or promotional activities. If a user participates in a survey, the information provided will be used together with that from other participants. We may share aggregated and individual anonymous data for analysis and research purposes.
v. Direct Marketing

Ticatag will collect certain information transmitted by your mobile device when you use these Services, such as a device identifier, user settings, Geographic Data, the mobile carrier, and the operating system installed on your device. Using the mobile versions of Ticatag Services may require users to log in through an account. In this case, information related to the use of the mobile versions of the Services may be associated with the accounts. Ticatag may also allow individuals to download an application, widget, or other tool for use on mobile or computer devices. Some of these tools may store information on mobile or other devices. These tools may transmit Personal Information to Ticatag to allow users to access accounts and enable Ticatag to use these tools. Some of these tools may allow users to send reports and other information by email directly from the tool itself. Ticatag may use personal or non-identifiable information it has collected to improve these tools, develop new ones, enhance quality, or for other purposes described in this Privacy Policy or any other documentation published by Ticatag.
viii. Use of Anonymous Aggregated Information.
Ticatag may use Personal Information and other information about you to create anonymous aggregated data, such as anonymized Geographic Data and demographic information, as well as information about the computer or device you use to access Ticatag Services or other types of analysis we create. We use such anonymous aggregated information for various purposes, including measuring visitor interest in different parts or features of the Services and how they use them. Such anonymous aggregated information is not Personal Information; therefore, Ticatag may use it in various ways, including conducting studies, for statistical purposes, internal analysis, and any other purpose permitted by law. We may share this information within Ticatag and with third parties for our purposes or theirs, in an aggregated or anonymous format designed to prevent anyone from identifying you.
viiiix. Sharing Content with Friends or Colleagues
Ticatag's Services include several tools and features. For example, Ticatag allows you to share information about your friends through our recommendation services, including "Recommend a Friend." Our recommendation services may enable you to send or share certain content with friends or colleagues, such as an email inviting them to use our Services. The content or links you wish to send them are sent to the email addresses you provide, knowing that neither Ticatag nor any other third party collects or uses them for other purposes. You agree that you are authorized by this person to provide us with this information and to allow us to use it for the limited purposes mentioned above.
ix. Other Uses
Ticatag may use Personal Information in which we have a legitimate interest, for example for direct marketing, individual or market research, fraud protection, or any other purpose we inform you of at the time we collect your Personal Information or with your consent.

B. Disclosure of Your Personal Information to Third-Party Service Providers

Ticatag uses third-party service providers and software solutions, including web hosting and other cloud services, to provide you with the best possible experience. We may share your Personal Information (including your Geographic Data and the Geographic Data of your Ticatag devices) with our third-party service providers or their affiliates (for example, cloud and hosting services, technical service providers, consultants, communication agencies, carriers, and customer support providers) so that they can provide, improve, and promote the Services on our behalf.
For example, we may disclose Personal Information to our service providers to enable them to communicate with you on our behalf. We may also disclose Personal Information to platform providers, such as Facebook, to allow them to display advertisements and promote the Services on our behalf on such platforms. Whenever possible, your Personal Information will be hashed or masked before being stored.
The Services may also allow you to share, with your permission, Personal Information about you with our independent partners ("Partners") in connection with the products and services they offer. Any sharing of information with a Partner will be subject to the privacy policy of that Partner in effect at that time. To protect your information, we recommend that you carefully read the privacy policies of all Partners with whom you share Personal Information.
We will not share your Personal Information with third parties without your consent, except as mentioned above.

C. Use of anonymized information

D. Data Retention

Ticatag retains the Personal Information we receive in accordance with this Privacy Policy for as long as you use our Services or as long as necessary to fulfill the purposes for which we collect it, to provide our Services, resolve disputes, present our defenses, conduct audits, meet our legitimate business objectives, enforce our agreements, and comply with applicable laws.

E. Privacy Shield

For onward transfers to agents under the Privacy Shield (or other applicable laws), it requires that Ticatag remains responsible if its agents process Personal Information in a manner inconsistent with the Privacy Shield principles.

6. WE MAY USE AND DISCLOSE YOUR INFORMATION FOR OUR PROTECTION OR THAT OF OTHERS.

A. Use of Your Personal Information

We may use and process your Personal Information, including Geolocation Data, to prevent fraud, misuse, violations, identity theft, and other illegal activities and abuses of our Services.

B. Disclosure of Your Personal Information

Like other companies, we may disclose your information to government or law enforcement authorities or private parties as we deem necessary at our sole discretion to i) comply with laws, regulations, or legal requests, ii) protect the safety of any individual, iii) address any potential violation of our Privacy Policy or terms of use, iv) investigate any fraud, security, or technical issues, or v) protect the rights or property of Ticatag, our employees and users, and the public.
Additionally, if we are acquired by a third party in a transaction such as a merger, acquisition, or asset sale, or if our assets are purchased by a third party in the event of business closure or bankruptcy, some or all of our assets (including all information collected from or about you) may be disclosed or transferred to the third-party purchaser in connection with the transaction, all in accordance with applicable data protection laws.

Please provide your full name, the email address associated with your account, and a detailed description of your data request. We process these requests in accordance with local laws. Under the Privacy Shield or other applicable laws, you may also inquire whether Ticatag processes Personal Information about you, request access to it, and ask for it to be corrected, changed, or deleted if it is inaccurate or has not been processed in compliance with the Privacy Shield Principles.
Although Ticatag makes good faith efforts to allow users to access their Personal Information, there may be cases where Ticatag is unable or not required to do so, particularly (according to applicable law) when the information contains professional secrets, would compromise other legitimate rights or privacy of others, when the difficulty or cost of access is disproportionate to the privacy risks for the user in the given case, or when it is commercially proprietary. In the event Ticatag decides to refuse access to such information in a specific case, we will explain our decision and provide contact details for further information. To protect your privacy, Ticatag will take reasonable steps to verify your identity before granting you access to or allowing you to modify your Personal Information.
Please note that the Geographic Data associated with your Account is an essential part of our Services and cannot be modified. However, if you do not want us to use your Geographic Data, you can delete it by deleting your Account, following the process outlined in Article 8 below.

8. POSSIBILITY TO DELETE THE ACCOUNT UPON REQUEST

We will proceed with deleting your information as soon as possible. However, some information may remain in archived/backup copies for archival purposes or as required by law.
However, please note that if you delete your Personal Information, your Geographical Data, and your Account, the Geographical Data associated with an active Ticatag product may still be collected anonymously by other Ticatag users running the application within Bluetooth range of your device. Nevertheless, since your Personal Information will be deleted, no new Geographical Data collected will be associated with your Personal Information. You can dispose of your Ticatag devices at a local electrical and electronic waste management facility or contact our customer service at support@ticatag.com for more information.

If you have consented to Ticatag processing your Personal Information or Sensitive Personal Information, you may withdraw this consent at any time and object to any further processing by writing to us at support@ticatag.com. Even if you object, we may still collect and use non-personal Information about your activities on our Sites and/or information contained in advertisements on third-party websites for advertising purposes without interest, in order to evaluate the effectiveness of said advertisements.
ii. Telephone and Email Communications

12. PRIVACY SHIELD

Ticatag complies with the requirements of the EU-U.S. Privacy Shield and the Swiss-U.S. Privacy Shield (collectively referred to as the "Privacy Shield"), as defined by the U.S. Department of Commerce and the Federal Trade Commission ("FTC"), regarding the collection, use, and retention of Personal Information transferred from the European Economic Area and Switzerland to the United States. The Department of Commerce certifies that Ticatag adheres to the Privacy Shield Principles and its Supplemental Principles. For more information and to file an individual data complaint with JAMS, a dispute resolution service provider with offices in the United States and the EU, visit https://www.jamsadr.com/file-an-eu-us-privacy-shield-or-safe-harbor-claim.
These independent dispute resolution mechanisms are made available to citizens free of charge. If a request remains pending, you can contact the national data protection authority of your EU member state.
You may also have the right, under certain conditions, to invoke mandatory arbitration under the Privacy Shield. For more information, see https://www.privacyshield.gov/article?id=ANNEX-I-introduction. The FTC has jurisdiction over Ticatag's compliance with the Privacy Shield.

13. WE TAKE SECURITY VERY SERIOUSLY

We implement various systems, applications, and procedures to secure your Personal Information to reduce the risks of theft, damage, loss of information, or unauthorized access, disclosure, alteration, or use of the information. However, please note that the measures outlined above cannot fully guarantee the security of your Personal Information. Thus, although we make considerable efforts to protect your Personal Information, we cannot guarantee, and you cannot claim, that our databases are immune to malicious acts, malfunctions, interceptions, illegal access, or any other type of abuse and fraudulent use.

A. California Privacy Rights

California law allows California residents to request from us, free of charge once a year, a list of third parties to whom we have disclosed Personal Information (if any) for direct marketing purposes during the previous calendar year, as well as the categories of Personal Information disclosed. Except as provided in this Privacy Policy, Ticatag does not disclose Personal Information to third parties for marketing purposes.

B. Australian Users

Except to the extent liability cannot be excluded by law, we exclude all liability (including for negligence) for the consequences of unauthorized access to, disclosure, fraudulent use of, or loss or corruption of your Personal Information.
